NINTH CIRCUIT COURT OUT OF CONTROL ON PLEDGE BAN:
A NEWSMAX.COM ANALYSIS
By Dan Frisa

NEWSMAX.COM - Recently, the Ninth Circuit U.S. Court of Appeals issued a decision ruling that reciting the Pledge of Allegiance in public schools is unconstitutional. Here we go with the latest from the "upside-down" Liberals on the federal bench.

Such lunacy only serves to heighten the importance of the Democratic-controlled Senate and its near refusal to even consider President Bush's judicial nominees, with fewer nominations acted upon than those of any other president of either party, in recent history.

This raw political attack on the President's constitutional prerogative to appoint judges of his own choosing, and who may share his governmental philosophy, began with the blatantly partisan admonition issued with glee by U.S. Senator Charles "Chuckie the Cheese" Schumer (Democrat--New YorK).

Not surprisingly, the media dutifully reported Schumer's outrageous contention that a political litmus test must be employed for all of the President's judicial nominees, with nary a negative comment or objection.

Can you imagine the horror and uproar that would have been provoked had a Republic issued a similar ultimatum?

This is the judiciary envisioned by Senate Democrats, their transparent posturing in the well of the U.S. Senate notwithstanding.

So, we see a federal judiciary run amok in ruling the Pledge of Allegiance unconstitutional, claiming its recitation in public schools was somehow an endorsement of religion by the state.

Huh?

Is the mere mention of God in a public school seen as coercive?

This is the latest incident in the long and storied attack on religion in general and on the Almighty in particular.

Recall the Rhode Island case in which a local rabbi was prevented from leading a commencement prayer? It's the same wrong-headed theory we see in the latest ruling.

All of our Founding Fathers referred to God and expressed the firm belief that thanks to God and praise of His will were essential to the founding of the American Republic. All of America's founding documents also express this firm belief.

A similat proclamation in the Pledge of Allediance, "one nation under God," is no more unconstitutional than the flag itself.

It's about time that Americans demand more of their senators. We must insist that the senators break the logjam on judicial nominations and leave their partisan politics and Liberal Leftist ideology at the ornate Senate door, evaluating each nominee's fitness to serve, instead of applying a partisan political and ideological litmus test.

Only then can we begin to reverse the ill-conceived turn to the lunatic Left in America's federal courts.
